Special prosecutors are looking to re-charge Alec Baldwin in the 2021 fatal Rust shooting as “additional facts” have recently come to light.

On Tuesday, prosecutors Kari Morrissey and Jason Lewis, who are based in New Mexico, where the movie was being filmed, said they will bring new evidence to a grand jury within the next two months.

“Additional facts have come to light that we believe show Mr. Baldwin has criminal culpability in the death of Halyna Hutchins and the shooting of Joel Souza,” Morrissey and Lewis reportedly said in an email. “We believe the appropriate course of action is to permit a panel of New Mexico citizens to determine from here whether Mr. Baldwin should be held over for criminal trial.”

Baldwin had faced two counts of involuntary manslaughter for the killing of cinematographer Halyna Hutchins, 42, but they were dropped in April as Morrissey and Lewis cited new evidence had complicated the investigation, requiring additional investigation and analysis.

In August, Morrissey suggested that charges could be refiled, pointing to a new report that examined both the revolver that was used on the set of the film and markings the gun left on a cartridge.

The report stated that the gun’s firing was caused by “the hammer being manually retracted to its fully rearward and cocked position,” followed by “the pull or rearward depression of the trigger.”
