ICE Arrests Illegal Alien And Alleged Child Rapist Released By Sanctuary County Near DC

Immigration and Customs Enforcement (ICE) announced the arrest of an illegal alien and alleged child rapist Tuesday, after he had been previously released by Fairfax County “sanctuary politicians.”

Walvin Victor Hugo Garcia, an illegal alien from Guatemala, was arrested by local authorities in June on felony charges of rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13 years of age, use of a computer to commit a sex offense with a minor, and distributing drugs to a minor, according to a statement from the Department of Homeland Security (DHS). During his initial arrest, ICE lodged a detainer requesting that Fairfax County not release Garcia and instead notify ICE so officials could pick him up; however, the statement said the county refused to cooperate and instead released Garcia from custody.

Garcia, who first entered the country illegally through Texas in 2023 and was paroled into the interior by the Biden administration, was eventually delivered a final order of removal in February. He was arrested by ICE on Friday, the statement said.

“Governor Spanberger and her fellow sanctuary politicians in Fairfax, Virginia, refused to cooperate with ICE and released this child rapist from jail back onto the streets,” Acting Assistant Secretary Lauren Bis said in the statement. “Thanks to our brave law enforcement, this sicko is out of our communities. Governor Spanberger and Fairfax sanctuary politicians are playing Russian roulette with American lives by releasing criminals from jail into American neighborhoods.”

Fairfax County has faced significant criticism from DHS, which cited in its statement four instances where illegal aliens charged with either murder or felony counts relating to pedophilia were released by county authorities.

The Daily Caller reported in April that three-quarters of the county’s murder suspects in 2026 were illegal immigrants. Both the county’s sheriff, Stacey Kincaid, and the commonwealth’s attorney, Steve Descano, have faced the most criticism for offering “insane” plea deals and refusing to work with ICE officials.

In April, ABC7 reported that both Kincaid and Descano were summoned to a hearing with the U.S. House Judiciary’s Subcommittee on Immigration Integrity, Security, and Enforcement entitled “Fairfax County, Virginia: The Dangerous Consequences of Sanctuary Policies.” However, the April 15 hearing was subsequently rescheduled to May 14, 2026.

The Fairfax County Sheriff’s Office and the Commonwealth’s Attorney’s Office did not return the Daily Caller’s request for comment.
