Class-action settlement: Deadline today for Batiste Dry Shampoo customers to file claim in $2.5 million settlement

The deadline is today for customers to file a claim in a $2.5 million class-action lawsuit settled with Batiste Dry Shampoo earlier this year.

Batiste Dry Shampoo and the marketing company Church and Dwight agreed to settle a class-action lawsuit over benzene found in its aerosol spray cans.

Consumers who purchased one or more Batiste Dry Shampoo items before May 30 could be eligible to file a claim by today. The payout each beneficiary will get varies depending on proof of purchase. The maximum amount for those without proof is $10, which is $2 per item if participants submit a maximum of five items. With proof of purchase, applicants could be entitled to a full refund via cash or vouchers.

A massive recall was issued in 2022 for various shampoos and conditioners such as Pantene, Aussie, Herbal Essences, Hair Food, and Old Spice over dangerous levels of benzene. Batiste, along with other dry shampoos, was cited in a 2022 report from an independent lab, Valisure. The lab tested over 100 samples from 34 different dry shampoo brands, including Batiste, and found their products used what the Food and Drug Administration considers to be toxic levels of benzene.

Plaintiffs argued this exposure to the chemical found in Batiste aerosol cans heightened their cancer risk. The owner of Batiste Dry Shampoo, Church and Dwight, has denied any wrongdoing but agreed to pay $2.5 million to settle the lawsuit.

No proof of purchase is needed to file a claim, and a form can be filed online here. Those who can provide proof of purchase for Batiste Bare and Clean or Batiste Light Bare products may receive a full refund.
