A New Mexico grand jury indicted actor Alec Baldwin on a charge of involuntary manslaughter on Friday after cinematographer Halyna Hutchins was fatally shot on the movie set of Rust in 2021.

The indictment revives the investigation into the incident after prosecutors dismissed an involuntary manslaughter charge against Baldwin in April. They later changed their decision and took steps to refile charges after receiving a new analysis of the gun used to shoot Hutchins.

Baldwin, who is the lead actor and a co-producer of Rust, was pointing a gun at Hutchins when the firearm went off, which killed her and wounded director Joel Souza. Baldwin said he pulled back the hammer but did not press the trigger, and the gun fired.

The judges had agreed to put several civil lawsuits from members of the film crew and others seeking compensation from Baldwin and other Rust producers on hold after prosecutors said they were presenting charges to a grand jury.

Although the actor has denied pulling the trigger, an analysis of the gun, led by Lucien Haag of Forensic Science Services in Arizona, found that “given the tests, findings, and observations reported here, the trigger had to be pulled or depressed sufficiently to release the fully cocked or retracted hammer of the evidence revolver.”

Hannah Gutierrez-Reed, who was the weapons supervisor, pleaded not guilty to evidence tampering and involuntary manslaughter. She will stand trial in February.

The filming of Rust resumed last year in Montana under an agreement that made the cinematographer’s widower, Matthew Hutchins, an executive producer, per the Associated Press.
