Republicans threaten AG Garland with contempt over Biden classified documents – Washington Examiner

House Republicans warned Attorney General Merrick Garland on Monday that they will move to hold him in contempt of Congress if he does not provide them with audio recordings of an interview that former special counsel Robert Hur conducted with President Joe Biden last year.

Reps. James Comer (R-KY) and Jim Jordan (R-OH) said, according to a letter they wrote to Garland, that the material the Department of Justice had provided to them so far in response to a subpoena was “insufficient” and “inadequate.”

They gave Garland until April 8 to comply with their subpoena.

“If you fail to do so, then Committees will consider taking further action, such as the invocation of contempt of Congress proceedings,” the Republicans wrote.

Comer and Jordan, the chairmen of the House Oversight and Judiciary committees, respectively, initially asked for several items related to Hur’s investigation of Biden’s handling of classified documents. Those materials included a transcript of an interview Hur conducted with Biden last October, as well as audio recordings of the interview and audio recordings of conversations between Biden and the ghostwriter of his memoir.

Comer and Jordan received a redacted version of the transcript from the DOJ, which House Judiciary Committee Democrats have since made public, but the two Republicans are also seeking an unredacted version in addition to the audio recordings.

Hur found in his special counsel report, published last month, that Biden had mishandled classified documents as well as disclosed classified information to the ghostwriter of his 2017 book, Promise Me, Dad.

However, based on the interview Hur conducted with Biden and interviews between Biden and his ghostwriter, Hur found that the president might give a jury reasonable doubt that he acted willfully because he came off as a “sympathetic, well-meaning, elderly man with a poor memory.”

The redacted transcript of Hur’s interview with Biden confirmed that the president did indeed have memory lapses at times, while, at other times, he was quick-witted and recalled information without issue.

Audio recordings of the interview could shed additional light on the president’s mental acuity, revealing the pace at which he spoke, filler words, or other items not captured through a written transcript.

The Department of Justice confirmed it had received Comer and Jordan’s contempt threat but declined to comment further.
