Biden judicial nominee fails to explain law terms when asked by Sen. John Kennedy

Sen. John Kennedy (R-LA) stumped one of President Joe Biden‘s judicial nominees while going through a speed round of questions about legal terms during a Senate Judiciary Committee hearing on Wednesday.

Sara Hill, Biden’s nominee for the Northern District of Oklahoma, was asked a litany of legal questions but could not answer the difference between a stay and an injunction.

“A stay — a stay order would prohibit — sorry — an injunction would restrain the parties from taking action. A stay order — I’m not sure that I actually can give you the—” Hill said.

She could answer most questions Kennedy asked her, including what the 13th Amendment and Seventh Amendment to the Constitution are, but she failed to state the difference between a stay and an injunction.

A stay order is when a court’s judgment or order is temporarily suspended, whereas an injunction order prevents a party in a case from doing a certain action.

After Kennedy’s questioning concluded, Judiciary Committee Chairman Dick Durbin (D-IL) joked by congratulating Hill on “surviving the John Kennedy six-minute bar exam.” Hill responded to Durbin by saying, “My contracts teacher is going to be appalled, and I’m gonna have to live with that.”

Hill has been championed by Democrats on the Senate Judiciary Committee as being an “accomplished litigator with deep ties to Oklahoma and significant courtroom experience.” If she is confirmed by the Senate, she would be the first Native American to serve as a federal judge in Oklahoma.

The Biden administration has touted its diverse nominees to the federal bench, including nominating Adeel Mangi, who would be the first Muslim American to serve as a circuit court judge if confirmed.
