FACT CHECK: Did Trump Illegally Wear A MAGA Hat To Vote?

A post made on X claims President-elect Donald Trump illegally wore a MAGA hat to a voting site on Election Day.

Verdict: False

The Florida Statutes do not prohibit individuals from wearing political clothing to Election Day voting sites.

Fact Check:

A post made on X claims Trump illegally wore a MAGA when he cast his vote on Election Day. The caption reads, “Convicted felon voting… illegal. Wearing MAGA hat while voting… illegal. Having Melania double vote for her… illegal. Trump Crime Family on Election Day. 🗳️”

The claim is false. The Florida Statutes do not prohibit individuals from wearing political clothing to Election Day voting sites. The Florida Statutes prohibit solicitation within 150 feet of Election Day voting sites, but they do not prohibit political articles of clothing (RELATED: Did Hillsborough County Close An Election Day Voting Site?)

Chapter 102.031 of the 2024 Florida Statutes reads, “No person, political committee, or other group or organization may solicit voters inside the polling place or within 150 feet of a secure ballot intake station or the entrance to any polling place, a polling room where the polling place is also a polling room, an early voting site, or an office of the supervisor where vote-by-mail ballots are requested and printed on demand.”

The Miami Herald reported that Florida voters are allowed to wear political clothing long as it is not distributed.The Miami Herald’s article reported, “You can wear clothing with political slogans or candidate names — including shirts, buttons and hats — inside the precinct if you’re planning to cast a ballot” and, “But you can’t distribute political or campaign material like fliers.”

The post also claims that Trump illegally voted as a convicted felon. The Florida Standards Governing Eligibility To Vote After A Felony Conviction state, “A felony conviction in another state makes a person ineligible to vote in Florida only if the conviction would make the person ineligible to vote in the state where the person was convicted.” Trump was convicted in New York and would be eligible to vote in that state.

A Palm Beach County Supervisor of Elections spokesperson confirmed to Check Your Fact that Trump did not break the law.

Check Your Fact has reached out to the Trump campaign and Florida Division of Elections for comment.
