A formal administrative complaint under the Help America Vote Act of 2002 (HAVA) filed against Colorado Secretary of State Jena Griswold on February 20, 2026, alleging systemic violations of federal election law involving post-certification alterations to Colorado’s statewide voter registration database. The complaint, filed under HAVA Section 402 (52 U.S.C. §15512), cites documented evidence that 487,887 voter participation history records were modified after elections were officially certified in 2020, 2022, and 2024.
328,895 Post-Certification Changes to 2020 Federal Election Records
After Colorado certified the 2020 General Election—which included President, U.S. Senate, and U.S. House races—the official voter database was later altered:
- 208,304 voter/ballot records were added
- 111,766 voter/ballot records were deleted
- Hundreds of “Vote” → “No Vote” and “No Vote” → “Vote” reversals occurred
Under HAVA §303(a)(4), states must ensure voter registration records are accurate and regularly updated. The complaint argues that altering participation histories years after certification either means the records were inaccurate when certified—or they were retroactively modified.
If the election tally WAS NOT accurate, why certify? If the election tally WAS accurate, why make changes to a federal record after certification? There is no third option. Either way, it’s a crime.
Tens of Thousands of Voter Records Deleted Post-Election
The complaint alleges violations of HAVA §303(a)(2)(B)(ii) and the National Voter Registration Act (NVRA), which require that only ineligible voters may be removed, and only after proper notice and waiting periods. Documented deletions include:
- 111,766 deletions tied to the 2020 General Election
- 79,383 voter/ballot deletions tied to the 2022 General Election
- 2,508 deletions tied to the 2024 General Election
These removals occurred after certification of federal elections. The complaint questions whether NVRA safeguards were followed in each case.
Massive Post-Election Database Modifications Raise Federal Security Concerns
HAVA §303(a)(3) requires states to provide “adequate technological security measures” to prevent unauthorized access to statewide voter databases. The complaint alleges that the ability to perform bulk additions and deletions of hundreds of thousands of voter participation records after certification demonstrates:
- Either insufficient technological safeguards
- Or mass authorized changes without transparent audit controls
Because Colorado’s statewide voter registration list serves as the official list for federal elections under HAVA §303(a)(1)(B)(viii), any instability in that database is inherently a federal issue.
The complaint formally requests:
- A hearing on the record
- Full forensic investigation of database changes
- Public disclosure of audit logs and access records
- Immediate preservation of all related system records
- Referral to the U.S. Attorney General and the Election Assistance Commission
Under HAVA, the Secretary of State must issue a determination within 90 days. We await Secretary Griswold’s reply.
