Jenna Ellis lawyer warns Giuliani should be concerned about charges in RICO case

A lawyer for former President Donald Trump‘s 2020 campaign attorney Jenna Ellis said Wednesday that he believes former New York City Mayor Rudy Giuliani should be worried about the 13 charges he faces in the wide-ranging Georgia racketeering case.

Frank Hogue, who helped arrange Ellis’s plea deal in the RICO case, said Giuliani should not necessarily be concerned about Ellis’s possible testimony in the trial but that there are other issues in the case that he should be wary of.

“I think there’s enough for Mayor Giuliani to worry about that wouldn’t have anything to do with Jenna Ellis,” Hogue told the Atlanta Journal-Constitution. “I mean, she wouldn’t be a help to him, I don’t think, if she was to be called as a witness. But I think his troubles extend far beyond her.”

Ellis pleaded guilty to one felony count of aiding and abetting false statements and writings in Georgia last week in exchange for no jail time and five years of probation. She also agreed to work with prosecutors in the future, including by testifying in the larger case. She was also ordered to pay a $5,000 restitution to the Georgia Secretary of State’s Office, complete 100 hours of community service, and issue an apology letter to the state of Georgia.

The former Trump attorney claimed she “failed to do my due diligence” as a lawyer involved with Trump’s post-election challenges back in 2020, and she expressed remorse at her actions in a tearful statement after entering her plea.

“If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges. I look back on this experience with deep remorse,” Ellis said.

The plea followed two other plea deals reached in the racketeering case by Sidney Powell and Kenneth Chesebro. Hogue said it was these deals that led to Ellis’s — she had initially rejected pleading guilty.

“I think what really accelerated it was Powell and Chesebro falling as they did, one right after the other,” Hogue said, declining to say whether prosecutors or the defense reached out first. “It looked like timing was of the essence for us.”

Fulton County District Attorney Fani Willis charged Ellis, Trump, Giuliani, and 16 others in August in a sweeping racketeering indictment that accused each of them of conspiring to keep Trump in power after the 2020 election.

Giuliani is facing 13 felony charges, including violating Georgia’s Racketeer Influenced and Corrupt Organizations Act, soliciting a violation of oath by a public officer, and giving false statements. Willis claimed Giuliani had participated in racketeering by allegedly unlawfully urging Georgia lawmakers to violate their oath by appointing presidential electors and “knowingly” making false statements about voter fraud to lawmakers during House and Senate meetings.

The former mayor has pleaded “not guilty” to all the charges.
