Ohio woman facing no charges after allegedly flushing corpse of stillborn fetus

An Ohio grand jury decided Thursday not to charge a woman accused of trying to flush the corpse of her stillborn fetus down the toilet.

Brittany Watts, a 34-year-old native of Warren, Ohio, was seemingly spared by the Trumbull County grand jury after its members chose not to indict her on charges related to felony abuse of a corpse, according to a report.

Had the legal process continued, Watts would have faced a prison sentence of up to five years and a $2,500 fine for allegedly passing the fetus she miscarried in September into a toilet.

There was probable cause to bind the case against Watts following the prosecution’s argument that she had tried to flush her 22-week-old fetus down a toilet because she had made multiple trips to Mercy Health-St. Joseph’s Hospital in the days leading up to the miscarriage, a local judge ruled.

There, a doctor informed her that the fetus she carried was nonviable and inducing labor would carry “significant risk” of death, the report noted.

“Justice has been served,” Traci Timko, legal counsel for Watts, said in a statement. “While the last few months were agonizing for Brittany, the grand jury has spoken and she is vindicated!”

“While Brittany’s fight for freedom is over, she stands with women everywhere and will use her story and experience to educate and push for legislation to ensure no other woman in the State of Ohio will have to put healing from grief and trauma on a back burner to fight for her freedom and reputation.”

Watts’s case garnered national attention due to its implications in a post-Roe world.

After the announcement by the grand jury, at least 150 supporters joined a “We Stand With Brittany!” protest outside the courthouse.

“I want to thank my community — Warren,” Watts told the supporters. “Warren, Ohio. I was born here. I was raised here. I graduated high school here, and I’m going to continue to stay here because I have to continue to fight.”
