Stefanik demands ethics inquiry into DC judge ahead of Trump election interference trial

House Republican Conference Chairwoman Elise Stefanik (R-NY) is demanding an ethics investigation into a federal judge ahead of Donald Trump’s election interference case in Washington, D.C., accusing the judge of using her position to “exact political revenge” against the former president amid his reelection bid.

Stefanik submitted an ethics complaint to the U.S. Court of Appeals for the District of Columbia Circuit on Friday, accusing Judge Beryl Howell of interfering with the 2024 election by using her position on the district court to harm Trump’s reelection chances. The House Republican leader specifically cited a speech Howell gave during the Women’s White Collar Defense Association gala last month, during which the judge warned the country was heading down an “authoritarian” path.

Stefanik slammed the speech as “highly inappropriate election interference” of the 2024 election that attempted to paint Trump as a threat to the country.

“I write today to express my serious concerns about, and request an ethics investigation of, DC U.S. District Judge Beryl Howell for her highly inappropriate political speech she gave last month, at which she suggested reelecting President Trump will lead to fascism in America.,” Stefanik wrote. “Judge Howell’s partisan speech is obviously highly inappropriate election interference by a federal judge that undermines the public’s trust in our courts.”

Howell made the speech during the gala with the women’s lawyer group on Nov. 27 as she received a “champion” award. During that speech, Howell urged her colleagues to preserve democracy by ensuring facts remain at the center of their work. The judge specifically referred to “big lies” that the 2020 election was stolen, claims she said later led to the Jan. 6 riot at the Capitol.

“My D.C. judicial colleagues and I regularly see the impact of big lies at the sentencing of hundreds, hundreds of individuals who have been convicted for offense conduct on Jan. 6, 2021, when they disrupted the certification of the 2020 presidential election at the U.S. Capitol,” Howell said in her speech, stopping short of calling out Trump by name.

Howell played a major role in the judiciary’s response to the Jan. 6 riot during her time as chief judge of the U.S. District Court for the District of Columbia. Howell later stepped down from this position in March but still remains on the bench, giving her some sway as the court prepares for its historic trial of Trump and his attempts to overturn his 2020 loss.

Stefanik criticized Howell’s remarks seeking to tie the Jan. 6 riot to “big lies” that were told about the 2020 election results. She also decried former Obama Attorney General Loretta Lynch, who also spoke at the gala and praised Howell for her handling of the subsequent Jan. 6 cases, comments Stefanik called “shocking.”

“It’s particularly shocking to hear the former Attorney General of the United States praise a sitting federal judge for her handling of the grand-jury proceedings on pending federal criminal charges against a defendant (President Trump), the pending criminal cases against his January 6 supporters, and even make the legal conclusion that an ‘insurrection’ occurred on January 6 ,” Stefanik wrote. “It’s even more shocking Judge Howell participated in this highly prejudicial public charade, not even disclaiming any of it.”

Stefanik cited a provision in the Code of Conduct for U.S. judges that prohibits judges from “advanc[ing] the private interests” of the judge or “convey the impression that they are in a special position to influence the judge.”

Stefanik accused Howell of using her 16-minute speech to push partisan statements and weigh in on the criminal case that is still pending in the court.

“Partisans cannot use our judicial system to exact political revenge against those with whom they disagree,” the complaint states. “The consequences for our legal system, Constitution, and country would be devastating. I urge you to investigate Judge Howell’s partisan speech.”

The complaint was submitted to Chief Judge Sri Srinivasan, who oversees the D.C. Circuit.

Stefanik has long been a staunch supporter of Trump throughout his legal troubles by defending the former president during both of his impeachment trials. The top House Republican has also submitted ethics complaints against other judges overseeing Trump’s civil fraud trials in New York over similar allegations of election interference.
