Supreme Court agrees to hear TikTok’s challenge to US ban

The Supreme Court will hear TikTok’s challenge to its looming ban if its parent company, China-based ByteDance, does not sell the popular video app.

The case will be argued on Jan. 10, 2025, just nine days before the ban is set to take effect. If the ban does go through, TikTok will be banned from all U.S. app stores. TikTok is arguing the ban is unconstitutional and violates the First Amendment.

Earlier this year, both chambers of Congress, with bipartisan support, voted to ban the app after years of questioning its possible connections to the Chinese Communist Party, leading to concerns about national security. In April, President Joe Biden signed the law, which requires ByteDance to sell the app or be banned.

As the case now sits before the Supreme Court, TikTok has lost all its previous court battles to reverse the law. The U.S. Court of Appeals for the District of Columbia Circuit refused TikTok’s request to delay the implementation of the law last week, which prompted the company to turn to the high court.

The company filed an emergency application Monday imploring the Supreme Court to block its ban temporarily. TikTok has argued that the possible ban violates its First Amendment right to free speech.

“Congress’s unprecedented attempt to single out applicants and bar them from operating one of the most significant speech platforms in this nation presents grave constitutional problems that this court likely will not allow to stand,” the social media platform wrote in its emergency application on Monday.

TikTok CEO Shou Chew met with President-elect Donald Trump this week. He has changed his tune on the app in recent months, saying he has “a warm spot in my heart for TikTok.” It is a complete reversal of his position on the video-sharing platform from his first administration when he, too, tried to ban the app via executive order.

As it stands, the TikTok ban is set to take place on Jan. 19, 2025, the day before Trump becomes president.
