Trump sues Michigan secretary of state over push to keep him off ballot in 2024

Former President Donald Trump’s lawyers filed a lawsuit Tuesday against Michigan Secretary of State Jocelyn Benson for her lack of response to correspondence regarding his 2024 ballot placement.
The suit alleges, “The Secretary’s failure to respond is creating uncertainty, which impacts how President Trump will allocate resources.”

Further, the 63-page filing said, “This uncertainty is compounded by the fact that Secretary Benson is an active member of the opposing major political party and has publicly weighed in with her negative views of President Trump.”
Trump’s lawyers noted there was an effort in Michigan to prevent the former president from appearing on the ballot based on arguments that the 14th Amendment disqualifies him. However, Benson has dismissed such attempts in the past, claiming she doesn’t possess the authority to determine eligibility.
The suit comes as a trial plays out in Colorado considering whether the 14th Amendment disqualification argument holds merit. “We are here because Trump claims, after all that, he has the right to be president again,” lawyer Eric Olson said Monday. “But our Constitution, our shared charter of our nation, says he cannot do so.”

Trump lawyer Scott Gessler maintained that “mere incitement through words” does not constitute “engaging” in an insurrection.
The two states represent the latest developments in a nationwide effort to keep Trump’s name off the ballot due to his role in the Jan. 6 Capitol riot. As the state primary elections and caucuses near, Trump appears more likely to become the Republican nominee for president, expanding his lead over competitors.
