The Washington Examiner’s Tiana Lowe Doescher argued that the “unprecedented” impeachment of Homeland Security Secretary Alejandro Mayorkas stems from his refusal to enforce the law “as written.”
Doescher’s assessment comes after the House of Representatives voted narrowly for Mayorkas’s impeachment on Tuesday night by a margin of 214-213. Doescher, a commentary writer for the Washington Examiner, explained the rules are clear for when a government official can be impeached, with refusal to enforce the law as passed by Congress being core to this.
“The issue isn’t that Mayorkas has just implemented awful policy,” Doescher said on Fox Business’s Mornings with Maria. “Overturning Remain in Mexico? Awful. Overturning the ‘safe third country’ deals that President Trump passed? Awful. The real issue is that he has refused to enforce the law as written.”
Doescher added that Mayorkas could very well be replaced by another person who would pass President Joe Biden’s “insane policy.” However, she reiterated that “something must be done” when a government official fails to do his or her job to enforce the law.
In the wake of the House impeaching Mayorkas, Biden greatly criticized House Republicans for their “blatant act of unconstitutional partisanship” for voting on the impeachment, claiming that history would not be kind to the 214 Republicans who voted “yes.” Biden also said Mayorkas had “upheld the rule of law faithfully,” calling him “an honorable public servant.”

With the House successfully impeaching Mayorkas, the movement will now go before the Senate, in which the Democratic Party holds a slim majority. Because of this, it is possible that Mayorkas will be able to keep his job as Homeland Security secretary.
Senate Majority Leader Chuck Schumer (D-NY) also possesses several options to delay or dismiss the impeachment trial. However, for the latter to happen, Schumer would need the help of centrist Democrats to join the simple majority vote needed for a motion to dismiss.
